An 86-year-old Afghan man who avoided jail today after being sentenced for indecently dealing with two children will not be able to leave his home unless accompanied by an approved adult.
Mohammad Hosseini was convicted in August by a District Court jury of the two charges, which involved molesting a 13-year-old boy at a Beaconsfield bus stop in December 2006 and a seven-year-old girl at a Fremantle soccer pitch in April 2007.
Judge Anette Schoombee sentenced Hosseini to a 16-month jail term that she suspended for two years. She imposed a condition that Hosseini not leave his house unless his daughter, granddaughters, who he lives with, or another approved adult is with him.
Judge Schoombee said Hosseini preyed on young children and his offences were brazenly committed in public – on the second occasion with adults just metres away. She said children had a right to feel safe going about their daily lives.
The prosecution called for an immediate jail term.
Judge Schoombee said a prison term would be particularly onerous for Hosseini given his age and deteriorating physical and mental health.
Hosseini is now a reportable sex offender.
The judge said Hosseini, who speaks hardly any English, denied his offending and showed no remorse.
Hosseini must also not be alone with any children that visit his house.
