One can look at Breyer's statements several ways. I happen to agree with Mr. Silveria's assessment much or most of what Breyer said was the product of negligible research and an indifferent education on the historical antecedents of our constitution by one or more clerks.

Justice Breyer is ultimately at fault for not catching the circular reasoning of his statement, and, more importantly, not being au courant with all aspects of our constitution which is the basis for determining all cases coming before him. >MW
