That particular line has been drawn in cement in the U.S. for some time now.

Regardless of sitting U.S. administration or world opinion, our rights are secured by "right of possession"; substantiated by several hundred years of Western Law, governing philosophy and historical precendent. Almost from its inception America has been both symbol and bulwark to those aspiring to freedom or seeking refuge from rapacious government. Now it appears the UN wants to usurp the role of dictator. >MW

Hey John Henry, you do know that the congress and the administration swore oaths to defend and protect the constitution and the law of the land says no treaty can supersede the constitution don't you.

In order to ratify that treaty they have to change the constitution first and even if 52% of the voters think the president they elected on water and his fecal matter smells like roses they aren't enough people to change the constitution no matter how badly they want to.

Quote:
This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.
Article six of the constitution:

The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.
A treaty no matter how badly wanted by the administration cannot supersede the constitution. Nobody and I mean nobody not even the Senate can ratify a treaty that overrides the constitution. In order to do that they would have to have to go through a long and difficult process, ie.

Quote:
The Amendment Process

There are essentially two ways spelled out in the Constitution for how to propose an amendment. One has never been used.

The first method is for a bill to pass both houses of the legislature, by a two-thirds majority in each. Once the bill has passed both houses, it goes on to the states. This is the route taken by all current amendments. Because of some long outstanding amendments, such as the 27th, Congress will normally put a time limit (typically seven years) for the bill to be approved as an amendment (for example, see the 21st and 22nd).

The second method prescribed is for a Constitutional Convention to be called by two-thirds of the legislatures of the States, and for that Convention to propose one or more amendments. These amendments are then sent to the states to be approved by three-fourths of the legislatures or conventions. This route has never been taken, and there is discussion in political science circles about just how such a convention would be convened, and what kind of changes it would bring about.

Regardless of which of the two proposal routes is taken, the amendment must be ratified, or approved, by three-fourths of states. There are two ways to do this, too. The text of the amendment may specify whether the bill must be passed by the state legislatures or by a state convention. See the Ratification Convention Page for a discussion of the make up of a convention. Amendments are sent to the legislatures of the states by default. Only one amendment, the 21st, specified a convention. In any case, passage by the legislature or convention is by simple majority.
Until they do that this is the law of the land and why I am one of the few apparently who is not running around in circles with my hands in the air crying "The UN is going to take my guns away."

Quote:
("under" designates that treaties are not over, not above, and not even equal to the authority of the United States granted to it by the States via the U.S. Constitution - but remain under, inferior to its jurisdiction).
A treaty may not do or exceed what the Congress is charged to do or what it is forbidden to do. Constitutional authority supersedes, overrules, and precludes any contrary treaty authority.

As per usual, Old Grump, you could post the weather report and I'd read it on TFF. Always enjoy your input and insight.

And seriously - no matter what laws "they" pass, who here would give up their guns? Show of hands.

The UN couldn't get the Africans in Rhuwanda to do as they were told.

After 2012 election, all this talk will disappear just like it did after the slickster was gone.

Grump ..... As usual, I agree with you.
Except for one MINOR detail .... our current crop of "professional politicians" owns and operates the supreme court . Sooo, when prez. osama ( dang, I mis-spelled
it again ) issues an executive order turning that treaty into law the supremes will over
rule any challange to the new un law.
Then, my friend, we'll be looking at a civil war between the g'ment employes and the
rest of the country.
