Default Help what is it?

I have a pistol marked on the left side: Pistole M. 37, Cal. 7,65 mm with a small bird shape and jhv over 41 with a serial # 3628
what is this?

It is a Frommer Model 1937, produced by the Frommer factory in Hungary in 1941 for Germany. A 50,000 piece contract was issued in 1941 for a 7.65mm (.32 ACP) version of the Frommer Model 1937 9mm Short (.380). Most of these contract guns were sent to the Luftwaffe, and the contract was eventually extended through 1944 with some 85.000 produced.

it does look like that but cal. is spelled cal. on mine but kal. on everything I've looked at(like your picture) and mine is a .32

There were several variations on the slide markings through the 4 years of manufacture of this contract. The guns manufactured for Germany were in .32 ACP (7.65mm).
