By Joshua Rhett Miller * ShareThis Gun rights advocates have a California police detective in their crosshairs after he apparently posted comments on Facebook advocating that "open carry" supporters should be shot. East Palo Alto Police Det. Rod Tuason apparently posted the remarks on his Facebook page in response to a friend's status update, which suggested that gun advocates who carry unloaded weapons openly — which is legal in California — should do so in places like "Oakland, Richmond and East Palo Alto" and not just in "hoity toity" cities. "Haha we had one guy last week try to do it!" Tuason replied. "He got proned out [laid face-down on the ground] and reminded where he was at and that turds will jack him for his gun in a heartbeat!" Several comments later, the detective suggested shooting the gun rights advocates, some of whom have carried firearms openly in recent weeks in California's Bay Area, particularly at Starbucks locations. "Sounds like you had someone practicing their 2nd amendment rights last night!" Tuason wrote. "Should've pulled the AR out and prone them all out! And if one of them makes a furtive movement … 2 weeks off!!!" -- referring to the modified duty, commonly known as desk duty, that typically follows any instance in which an officer is investigated for firing his weapon. Those comments caught the attention of a California attorney and blogger, as well as a Virginia man who started a Facebook group calling for Tuason's termination. John Taylor, whose Facebook group had 54 members as of midday Friday, said the Facebook thread confirmed gun owners' worst fears. "Any sworn officer who suggests shooting law-abiding citizens for exercising their most basic constitutional rights deserves the full wrath of America's gun owners," Taylor told FoxNews.com. "It's an affront." California's Penal Code makes it illegal to carry concealed weapons without a county-issued license. But it is legal to carry an unloaded weapon in plain view in a holster. In most cases, it is illegal for an unconcealed weapon to be loaded. Taylor, of Arlington, Va., who has a concealed weapons permit in his home state, said he planned to write a letter to the East Palo Alto Police Department demanding that Tuason be fired. "The targeting, harassment and intimidation of law-abiding citizens who are peacefully agitating for their rights by a police officer is an abomination to the Constitution, and is in fact the exact reason our Founding Fathers created the Second Amendment," Taylor said. "Police officers who think they are going to get between law-abiding Americans and their Second Amendment rights are going to find themselves in the line of fire." Tuason's comments were first noticed by California attorney Kevin Thomason, who posted a screen grab of the detective's remarks on his Web site on Sunday. "[Tuason] didn't realize that actual PRO-GUN people also read Facebook," Thomason wrote. "Amazingly, he posted the following comment about law abiding gun owners on a friend's page. Basically, he's saying 'prone them out' (face down on the ground), and if anyone moves, kill them. I don't make this crap up." Thomason, a member of the National Rifle Association, wrote that Tuason's comments were "worth a call" to the East Palo Alto City Council, as well as to his superior officers. Tuason, who has since removed his Facebook profile, did not return messages seeking comment on Friday. He is reportedly being investigated by the police department's professional standards division regarding the Facebook remarks. East Palo Alto Police Sgt. Rod Norris said he was unable to comment on the matter, but Capt. Carl Estelle told the San Jose Mercury News that police officials must be careful not to violate Tuason's First Amendment rights, since the comments appeared on his personal Web site. ----------------------------------------------------------------------- so he can advocate killing innocents who only wish to obey the laws and use procedure to have a holiday over it.. may i suggest a play out of the pro gun folks here's own book a letter ------------------------------------------------------------------- maybe a letter we each sign and send off to the press and the cops such as "Dear XXXXXX CC XXXXX media CC XXXXXX media CC XXXX media I write to you about a law officer who promoted the shooting of people who wish to engage in thier constitional rights. In this day and age where our rights are being deminished at a ever alarming rate, this promotion of lethal force against those who wish to engage in thier constitional rights is abhorrent and a incitement to 1 Murder an innocent citizen. 2 Deny on mass, rights given to us by the constitution of this nation.. 3 Treat people of this nation as though they are simply serf's to the powers that be, and as such can be slaughtered at will by anyone representing this power. We request the immediate resignation of this mans superiors if they support this officers action and his immediate dismissal from the law enforcement agency and that criminal charges of incitement to murder , denial of Constitutional rights and sedition be placed against this person. I am a voter I am a citizen I am a beleiver in our constitution and I do intend to be VERY VOCAL and write my lawfull representatives and demand action in this matter. Their right he should be fired. but it being California and the Bay Area he will probably be given an award for bravery.

And, guaranteed he's not the ONLY psycho-power tripping-jack-booted thug on the force - or any force for that matter. They're everywhere, and they are a danger to law abiding citizens.

graehaven, your probably right there,
but from my own small experience with US cops most are decent folks i hitch hiked around the last trip , they'd pull over and check me out as is thier job but only one was a mongrel all others where pretty good , but that one bad one . sheeesh it happens but when theres a bad one you GOTTA get rid of him , and the best way is to make his bosses not want to cover him with THIER BUTTS ( jobs pensions etc) come out here where we have some real limp wristed ones especially when it comes to the jihadi's , wont do nothing , and then we have the opposite end the nutter , "i gotta badge so I"M GOD " compex types , its real hard to find a average type now , the good ones try not to get into strife and become limp wristed by default.. the Psycho's we'll they either get promoted to the gang squads or get sued to oblivion , wheres the good in either kind?? cheers jack |

Well, I thought of it this way. Anyone who's dumb enough to carry an unloaded firearm in plain site probably has a high probability of being shot. That's just dangerous. They're inviting attack but don't have the 'ammo' (pardon my use of the pun) to defend themselves.

Being that I'm a law enforcement officer, you would think I would be offended but I'm not becuase it is so true. There are a lot of folks that shouldn't be in law enforcement and this is a good example of one that shouldn't. When I picked my agency, I had worked as a police officer in San Diego and if I didn't like the officers with a particular agency I wouldn't apply there. I could never be a DEA, FBI, or ATF. I work with some great people and we weed out the ones that shouldn't be in the academy. Don't make the mistake of lumping every law enforcement officer into one group. We take an oath to defend the Constitution and many of us are vets that served proudly. If he isn't dismissed from his job and if that LEO ever shoots someone the lawyers will take care of him. Making inflamatory statements like that and then following thru will leave him penniless and quite likely in prision for life. He may not get a life sentence but it will be.

I am not sure why someone would carry an unloaded gun, open or concealed.
Kinda like a baseball player, going up to bat, bare-handed.

I'm working in Lordsburg but I'm living up in Silver City. I started out in San Diego and worked in Ajo, Arizona and Grand Marais, MN. It's good to be here! I love shooting and everything firearms. Hope to get to know ya all.

Right you are. Most of the folks in law enforcement are good guys doing a tough job. It's the bad ones that can make your life a living hell. I support LEO's and am not a criminal type, but I reserve the right to defend my life and property and will not entrust it to someone I don't know intimately.

I understand the need to excercise one's constitutional right by open carry to protest the denial of those rights. However, Why carry an unloaded weapon? An unloaded weapon is equivalent to carrying a big stick made out of styrofoam and it risks getting your firearm confiscated or at the very least severly abused. Why not get on board by Carrying an Empty Holster. That will get peoples attention and leave them quessing as to where your firearm maybe. They would probably be more likely to ask you the purpose for the empty holster than when you had a firearm in it. Does Cal-lie-forn-ni-cate have a law against carrying a toy pistol openly? Why not use that option?

I couldn't stand the people there. Way to liberal, clickish, and pretty much ignorant to everything going on in the world. I missed the action on the Southern Border. I do miss my big home on the shore of lake Superior and believe it or not I liked the winters but the small town drama wasn't worth it. |
