Default Jasmine Tea = Temporary Insanity?

Basically, this guy goes on a rampage, breaks into a neighbor’s house and chases her with a dagger. His defense? He was temporarily insane, due to massive quantities of jasmine tea. The court actually bought this story, and the charges have been dropped.

What’s next? People claiming temporary insanity because they were under the influence of crack?

Personal responsibility is a big issue with me. Ok, so jasmine can be hallucinogenic. How about doing a little research before consuming mass quantities? How about seeing a doctor when the first few cups of tea didn’t help the stomach problem? How about realizing after that fifth or sixth cup that maybe it’s affecting my perception and maybe I should stop drinking it?

Come on! This guy was using the jasmine tea to get high, plain and simple. And when you allow yourself to be altered -- by alcohol, by drugs, or even by jasmine tea – and you screw up while under that influence, you should be held accountable.

But, your honor, I didn't mean to kill that family of four with my car!! I was under the influence of alcohol and didn't have control of myself!!

Keep in mind that this was in Florida. The same state where "I'm too stupid to understand the ballot" is also a good basis for lawsuits.

This ruling sets a dangerous precedent. Not only does it further do away with personal responsibility, but it allows mind-altering substances to be a good defense. Might as well do away with any further "intoxication manslaughter" charges. Because anyone under the influence of anything is now exempt from any wrongdoing.

Maybe now the BATF will start regulating jasmine tea, slapping taxes on it, and making it illegal to drink unless you're 21.

Dan White walked into City Hall in San Francisco in the mid 80's and shot Harvey Milk to death at his desk. Dan White's defense was temporary insanity due to eating too many twinkies. He all but got away with it. It is now called the "Twinkie Defense" strange, but true! Go figure.
