After thirteen years in publication and with over 75,000 copies in
circulation, THE FEDERAL MAFIA: HOW THE GOVERNMENT ILLEGALLY IMPOSES AND
UNLAWFULLY COLLECTS INCOME TAXES, AND HOW AMERICAN'S CAN FIGHT BACK, is a
book the Government is attempting to ban along with supporting instruction
materials published by Mr. Schiff and sold at his store, Freedom Books here
in Las Vegas. No explanation was offered for the Government's neglect, The
United States Attorney, Evan J. Davis, ran to the District Court for an
emergency "Temporary Restraining Order" claiming that "Irwin Schiff has been
running the biggest 'Tax Scam' in U.S. History for over 30 years", and,
without as much as opening the book to refute one statement contained
therein, and, before any sworn testimony was given to support the Government
's claim, Lloyd D. George, United States District Court judge, issued an
Order restraining the sale of the book, materials, and the defendants speech
on March 19, 2003. The Order can be viewed on the Internet at

Last week, Irwin Schiff told readers of THE LAS VEGAS TRIBUNE newspaper that
four agencies and organizations have joined the ACLU in battling for the
life of the First Amendment by requesting that Judge George allow time to
file their "Friend of the Court" briefs in Mr. Schiff's "Preliminary
Injunction and Book-Banning" case. They are: the Association of American
Publishers, the American Booksellers Foundation for Free Expression, the
Freedom to Read Foundation of the American Library Association, and the PEN
American Center. The PEN American Center is a professional association of
over 2,600 literary writers (poets, playwrights, essayists, editors, and
novelists) that promote literature and seek to protect free expression by
mobilizing the literary community to defend the First Amendment whenever it
comes under attack, as is the case here.
On May 12, 2003, all parties' "Friend of the Court Briefs" were due to be
filed with the United States District Court for a ruling by Lloyd D. George,
on the Government's complaint against Irwin Schiff and associates for this
"Preliminary Injunction and Book-Banning". The U.S. Department of Justice
Attorney, Evan Davis, Mr. Schiff, his two co-defendants, Mr. Cohen and
myself, and all "Friends of the Court" on the First Amendment issue, now
await and anticipate Judge George's verdict on the Preliminary Injunction
based upon the pleadings, testimonies, hearings, and, the Post Hearing
Briefs.
Mr. Schiff's "banned" book, research and applications are published to
protect citizens against illegal I.R.S. employee abuses as defined by
Congress in the law. (Irwin Schiff's Freedom Books sells more Internal
Revenue Codes than any other retailer in America.) The Internal Revenue Code
provides that the public have protections from unlawful liens and levies,
(Sections 6320 and 6330), and, in the alternative, remedies, (Sections 7433
civil "remedy" and 7214 criminal "remedy"), whenever Internal Revenue
Service employees act outside the bounds of their legal authority, executing
the enforced collection of the "income tax".
When enacting these statutes, the legislative intent of Congress and the
Senate was to safeguard the Public from unlawful acts of Revenue Officers.
Congress outlined certain specific procedural requirements that must be met
before the I.R.S. "can" lien, levy, or seize property for the payment of the
"income tax". Irwin Schiff's books and research materials inform and
instruct individuals how to use these policing statutes and various other
provisions of the law to guard against wrongful acts committed by I.R.S.
agents. When Internal Revenue Officers do not abide by the laws, Irwin
Schiff and his associates show the Public how to move to the Courts for
relief as the law instructs the Public to do. This is the real basis of the
Government's complaint: Mr. Schiff and his two co-defendants read the law
word for word out loud so that the Public may understand its rights when
dealing with the Internal Revenue Service.
The Government assures citizens that are indeed being protected by those
laws, ("They're on the books, aren't they?"), when in truth, the Public has
no protection whatsoever. Through the work and the dedication of hundreds of
thousands of Irwin Schiff's students all across America, the 1998 Internal
Revenue Service Restructuring and Reform Act, (administrative "due process
appeals rights" subject to Judicial review), has been exposed as a fraud.
The new laws only served to justify hiring thousands of new employees at the
"Service"; establishing some very impressive "programs" and "branches" at
the "Service"; while Revenue Officers went back to doing all of their
pre-1998 "business as usual" extortion and raiding tactics.
Irwin Schiff exposed "the show" in his teachings. His students followed the
letter of the law as they appealed adverse determinations resulting from
"pretend collection due process hearings" where the "pretend impartial
appeals officers" completely abolished the provisions of this entire Act of
Congress. That part could have been expected since agents of the I.R.S.
have been operating illegally for decades regarding the collection of the
"income tax", but what the students have found as they proceeded under the
law to the judicial review is that the I.R.S. is stealing as usual only now
they enjoy the cover of America's Courts. It has taken all of the past four
years since the enactment of the 1998 Restructuring and Reform Act to get
these cases into the Courts where the integrity of the Act has finally been
challenged.
Over the course of the past two years, the Courts have made some very
embarrassing rulings indeed, calling the relevant points of law and issues
of fact, (such as the question of the existence or the amount of the
underlying liability), "frivolous". Frivolous is the word that the
Government uses whenever it wants to take something that legally belongs to
a citizen and the citizen objects to the taking by citing the law. Frivolous
means, "We want it and we are taking it, and if you insist upon challenging
this action, the Courts will put monetary sanctions upon you for up to
$25,000.00 if you go there asking any questions about it." Because of all
this new activity surrounding the 1998 Act in the Courts and the resulting
illegal rulings, the Courts have a vested interest in covering up their own
mistakes and abuses, and now they must close Irwin Schiff's business down
and ban his book so that people will not know that there are laws to protect
them.
The Government and now the Courts do not want the Public to know the truth
about the "income tax" which was actually repealed in 1954, and is exposed
in the teachings of Mr. Schiff. If the Public should find the truth, the
Government wants the Public to pretend that the truth is not the truth. The
Government does not want Irwin Schiff to talk about these lawful protections
when dealing with the I.R.S., so the Department of Justice moved in with NO
constructive NOTICE whatsoever, with a raid and siege of the bookstore in
February, followed by the Injunction in March, praying that the Court will
ban a book, gag an author, radio talk show host, and speaker, by calling
him, "The Biggest Tax Scammer In U.S. History".
This writer hopes to encourage all taxpayers to start watching these Court
Cases as they go through the Courts, and especially the citizens that do not
believe in what Irwin Schiff is writing and saying. Everyone should
definitely be concerned about the outrageous amounts of taxpayer dollars
that have been wasted in all of these actions taken against him and his
business when he has continually offered to close it down himself whenever
the Government would produce a law making persons liable for or required to
