If you hit the person driving away and killed him you would be charged with murder.
The bad guy was driving away At the point that the guy who was shooting was in NO danger.
You only shoot when you have no choice and are in do it or die situation.
Or face a jury to explain why you shot.

Grey area, I think in some circumstances that if you know a felony has been commited, you can shoot to stop a fleeing felon.

The guy who had his Ford ranger stolen should have shot him. Anyone points a gun at me they had better pull the trigger quick because mine's coming out and it's gonna get warm. Another good reason to be armed, we get wrecks in front of our house at least once a year or so, there's a sharp curve on a 50mph road. I would for certain be armed.

Never shoot at someone fleeing, good way to end up in jail. But hey, do what your freedom can handle.

Thought I would add that even a cop has to be careful when using deadly force to stop a fleeing felon.He better have a dam good reason to shoot.

This is a timing issue. If you could nail him while he was facing you with a gun aimed at you then you'd probably be ok. Otherwise it's up to the police.

NO

A local deputy sheriff was chasing a suspected dope dealer who had already caused another sheriff car to wreck during the chase. He fired at the truck's tires and hit the top of tailgate. Bullet went into back window and killed driver. He was charge with murder and went to prison. He is now out but has a felony murder on his record. ( He is a friend of mine)

My father was a Federal LEO for 30 years, when he started the job, he could shoot:

to protect Gov't property
a fleeing felon
anyone in the act of committing a felony
and of course personal defense

when he left the job, he could only shoot:

if you were in grave danger of bodily harm/death and you had better be bleeding!

No way.

Here, Tennessee code 39-11-611 allows the use of deadly force if you genuinely believe you are in danger of death or serious bodily harm.

There is no requirement to retreat.

Tennessee code 39-11-612 extends that to the defense of a third person.

No. For the reasons given above. The bad guy is posing no threat to anyone in the immediate area except himself and other road users if he is driving recklessly. If he was driving straight at me that could be justification.

What about shooting to disable the car, bearing in mind Gabob's friend's experience?
