well, I just went blind trying to read thru fl law concerning private sale of a gun.
I 'know' that in florida, a citizen can sell another a gun, face to face as long as they are not known to be a felon.. etc. i'm trying to find a bit more info on this. there's a guy that comes in where I work that may be interested in buying a gun or two from me.. or even perhaps a combo sale / trade. I'm more of a collector.. not a seller so much.. ![]() though I do know that anything that came in thru my C&R must have a disposition record in my bound book ( to match the aquisition.. etc. ).. but stuff I got newer on a 4473??? no such book exists..e tc.. I'm not aware of any record keeping that I have to do and or maintain? just making sure this is correct? someone have the applicable paragraph or 2 bookmarked in fl statuets..e tc?

Don't want to discourage you, but do you know this guy well? Your choice of phrase has my antennae up. If you've ANY doubts about the sale, drop your gun's price by what a local gun shop would charge as a transfer fee, and run the transfer through the shop's books. They're then responsible for the NICS routine and 4473s, not you. Just a thought from someone who'd spent 30+ years in the firerarms business.

You guys and your made up stories of gators and dogs eating your guns, how silly. However I see your concern, you are afraid that our wonderful leaders will realize if they sieze our guns, then they will have ultimate power over us. Just like half our population realized they could vote to have the leaders sieze money from the working half and give it to them. Not only do I see your concern, but one night while bemoaning the loss of our country, and enjoying a sip or two of VO I decided to protect all my weapons by wrapping them in oil cloth and taking them into the near by woods and burying them. That is the smart way to do it. If I need them I will just go dig them up, if only I could remember where I buried them??? Hmmm. It's been so long. And after that last storm and all those trees blew down. ????

I know here in Idaho it is not the seller who is responsible if a felon buys a gun from him. It is the felon who is responsible for having broken the law. When I made the straight across exchange for my 1911 in exchange for my SKS I discussed this with our Sheriff. All I did was write up 2 copies of a transfer of ownership document with both mine and the new owner's name, address and DL number on it, recorded the serial numbers of the pistol I was receiving and the rifle I was trading for it. The young man who made the trade has a copy and I have a copy and each copy has both our signatures. As far as Idaho law is concerned I have done my part legally and am protected by the law. With the document I drew up, I actually did more than Idaho law requires.
Granted, If I suspected anything when meeting the guy that even made me feel uncomfortable in the slightest way, I would not have made the deal. I would have walked away. However, this young man was obviously one with a job and paying off his car loan and I had no reason to suspect anything was abnormal. However, cases certainly do exist that are not above board. My wife and I were just having dinner with friends last night and the guy of this couple has some very nice pieces. Most of his guns have custom engraving that is just fantastic. Someone up the valley has asked him a few times if he'd be interested in selling one of his pieces. Turns out, the guy does have a felony record. My friend was wise enough not to sell him anything (I don't think he'd sell any of his pieces to anyone actually) ![]() |

Guy I knew back in the '60s came within an ace of getting locked up by ATF on charges of selling an unregistered NFA firearm (short barreled M1 carbine) to a felon. It was, of course, the felon who broke the law initially by purchasing a firearm (private sale, not from a dealer), then componded the felony by shortening the barrel and stock to the point the rifle resembled a Universal Enforcer Carbine. When eventually caught with this thing he naturally put the blame for the alteration entirely on the seller (felons are known to lie). By the grace of God there'd been enough witnesses to the sale to afirm the rifle hadn't been altered before transfer of ownership.

Generaly if my antena goes up the sale don't happen. Just anything that raises my doubt in what they say, no law says you have to sell anything. That said under FL law if you do not know that they are are a fellon or otherwise not allowed to own firearms a face to face transaction is okay.

The first time I wanted to sell a gun I went to the local police station and asked if there were any requirements that I needed to know about. I was told no, except that I couldnt sell to a "known" felon. I asked how would I know if the buyer was a felon and was told..ask him/her. I have sold many guns since then and have never had a problem. I try to use good judgment when appraising the buyer. Almost always it would be an older person that I would deal with. I dont sell to young people especially if their pants are worn a foot or so lower than their underwear.

Sorry for the delay in answering - was busy with firewood chopping chores. There was nothing specific in your comment that raised my antennae; it's just that I'm originally from the NYC area, where if asked "oh, you have some guns? Want to sell some?" my antennae would go up immediately, unless I knew the person. Sorry if my post sounded alarmist - didn't mean it to be.

You didn't say he is an acquaintance that you know - he is just 'some guy'. Now, if he is someone you know a bit - no problem. If you wish to sell him something from your collection you may certainly do so. I do recommend that you draw up a simple sales document to record the transaction, that you both sign it and you each keep a copy. As the seller, this is for your own protection. I will e-mail you you the copy of the agreement I drew up modified for simple sale if you would like. Just PM me.

Nothing about your post gets me thinking , but I haven't met the guy. If in dealing with him he make comments about potential criminal acts, or gang or drugs use, I will pass on the sale. In general if they don't seem like someone I would invite to the house for a beer or cookout I won't sell them a gun.

we talk about hunting often and he has invited me out to his property for hog hunts. I've never actually went over to his place.. but have talked to him on and off casually for years.
