Talking Terroristic Taxing Tactics......this is a good one!!

When i moved to Arkansas 12 years ago to work for my dad who had just bought a Dimentional Stone Company, i literally had nothing but the cloths on my back....A lengthy devorce/custody battle saw to that....

So anyway, i went down to the place where they issue drivers liscense's, which in Arkansas is not the Department of Motor Vehicles....here it it the Department of Revenue. To me thats weird, but whatever....
So i take the written test, which i passed, i then gave her my Nebraska's drivers liscense and they started the whole process of taking my picture...and all that crap......waited a little bit...and they give me my new Arkansas Drivers Liscense. End of sentence for 4 years....or so i thought.....

Now when i first got here i did'nt have a vehicle with me to liscense because my dad made me drive the uhaul truck while he drove his pickup with his van in tow...i had to leave my old impala behind....
Which really ticked me off when my folks refused to take care of my daughter "2yr old" for 2 days while i took a greyhound bus back to retrieve my car.....
For this i will "get him back" by someday burying him in an unmatching plad leisure suit, with white shoes someday when he passes away.......Mark my words!

So then in the mail comes this letter from the county tax collector stating that i owe a whopping $2.25 county tax for....."personal property"
Now at the time both my, and my daughters wardrobes, which consisted mainly of donated items could hardly be worth a whopping $20 bucks at most....this was afterall right after a lengthy devorce.....lengthy not because it was contesed in any serious manner, but lenghty because half the time my soon to be exwife did'nt show up for court!....nor for her visitations either....
That cow went through 7 lawyers in the 2+ years it took to "finalize" the whole thing.....In Nebraska, the case can't proceed unless both parties are there....

Anyway, back to the Tax without Representation.....
If you think about it....$2.25 on about $20 worth of stuff is a 10% tax on items that they had no proof that i had, nor did i ever "make an assesment" that i owned any items of value.....
I called them about this asking why they were taxing me out of the blue so to speak....and they asked me if i owned any furniture, or dishes, a tv, ect ect ect....to which i truthfully replied no to each question, and then.........and, I'm not kiddin here....she said to me.....ok, so its for the cloths on your back then!!

HOLY $HIT!!! I could'nt believe it.....just flabberghasted i was....

So my dad takes over operations of his new "treasure", the stone company. A couple of years goes by.....and i am driving my dads truck full time....which was the least he could do considering that because of his obstanance (sp)? I did'nt have my car anymore.....and finally i get enough money up to buy a car... a ten year old clunker.......So i go over to the Department of Revenue to get it liscensed and they tell me that i need to go acros the street to the Collectors office to make a personal property assement on the vehicle before i will be allowed to purchase a liscense for it........hmf...I'm thinkin to myself..rural Arkansas..rural Arkansas.......
So I get over there and they ask me my name, and want to see my title and purchase agreement....whatever had the price of the vehicle on it.....
After a couple of minutes she tells me that i had 2 years of unpaid personal property taxes...both years being..the $2.25 and i think the second year was $2.75 or something or another....
And then she tells me that both years, plus penalty, and a "publication fee" for being late brings the total up to $20....
WTF?!!!....i did'nt say that, but it was what i was thinking! So now an unjust 10% tax on the "cloths on my back" has just been raised to a whopping 50% tax on the "cloths on my back"......

Angry as i was, i payed the woman, signed off on a paper that i bought this car for x ammount of dollars, she gave me my "all clear" papers, and back to the Department of Revenue I went.....
I got the car liscensed and went home.

Several years go by....i played their games every year, added/changed vehicles a few times...went through the hoops until the final straw in 98 when i questioned the assesment because it was starting to get in the real money category.
It turned out that they had not deleted several vehicles from my assesment list that had been sold, even though i had made notification every year, which vehicle i did and did not have....they were still billing me for. So they take all these off and reduce the ammount owned.....except for one.....that very first car that i bought here in arkansas.....which had not been operational since...96 i think. She asked me if i still had this car, and i said yes, and she said "then your gonna have to pay for it", and i said but its not operational......she said "it does'nt matter.."
I then told her that it has'nt been liscensed since 96 and that it has been sitting up in Missouri for several years being used as a parts car for a friend of mine.......
So she sits there....sqints one eyeball and looks at the ceiling with the other and finally says.....still does'nt matter......until you sell the car........
WHAT THE......!!!.. Caught myself before i said the last word....

So, i said the heck with it.....
I went and sold my car to my dad for one buck ($1) and gave him the money every year to cover the tax that was now in his name....i told him i just could'nt handle the idea of handing any more money over to these schmucks......
So thats the way we've done it since 98.
Ha....the Department of Revenue tried to refuse my dad liscense plates based on the fact that you "can't buy a car for a dollar"...those sorts of things are'nt done arround here.......

Oh god...........

Now here's the funny part....
The collectors office kept sending me yearly demands for a $2.80 here and $2.45 there....included were always the Penalties of $0.25 all the way up to $5.00....they fluctuated like a swimmer swimming the breast stroke or whatever its called where they bob up and down......

Finally i sent them a certified letter saying that in "2000" i sold the car....did'nt provide any proof...just claimed it so.....

In 2001 they sent me a single demand for $2 something in taxes for that car "for year 2000".....absent was the 98, 99, and 01 yearly demands for taxes, penalties, and publication fees...?

So i sent them back a letter telling them i was'nt gonna pay it,.....they sent me a letter back,....i sent a reply back for that one....ect ect ect....
THe final letter was from them telling me they were going to garnish my wages for that $2 something.....

Oh jeeez.......
I just laughed it off and forgot about it......

2 years later "03" they sent me another demand for the yr 2000 tax on that car....with a quarter added for penalty and i think a nickel extra for publication.......NOTE: comicly enough since 98, none of the demands for tax money have said anything about personal property for 98 though 02......just that old year 2000 unpaid $2 something.....
So, i sent them back a letter stating that i did'nt owe that tax, and i was'nt gonna pay it either....and Oh i almost forgot....BITE ME!!
The words BITE ME, i looped them and filled the rest of the page with that defiant call to action.....
That was last year....

This year she sent me the usual demand with the penalties and publications upgraded to............$4.26 demand for tax.....But this time is different........this time she had photo coppied entire pages from some kind of "COMPLIANCE GUIDE"....in which has references to a section of the annotated state statute book....sect 26-36-206 DISTRAINT OF GOODS TO PAY DELINQUENT PERSONAL PROPERTY TAXES..........

It goes on to talk about those "by such and such a date" stuff that taxes are due...........Costs of the Distress......and that goods and chattels for taxes levied shall be seized.......
And get this....SHE USED A HIGHLIGHTER TO HIGHLIGHT HER FAVORITE PARTS.......
I about fell out of my chair laughing.......

I don't know how I'm gonna "one up her" this year, but i have got to think of something....something good!!

Ideas anyone?

It makes me think........the company quarry is on the side of a hill and according to the map, right next to "Smith Hollow"........
It makes me wonder if they are just stupid enough to make something of this original $2 now balooned into $4.26 enough to come out and start someting.......

I can just see it now.........all the pro RKBA's people talking about the "incident" at Smith Hollow, Arkansas......

I swear, if i even catch a whif of that Lon Horiuchi crawling arround in the woods..........

if they taxed me here on untagged trucks i'd be screwed. with my offroad only trailered 4x4 mud toy collection growing and parts trucks to keep em goin i'd be screwed! even though my part trucks are the free comin haul it off stuff. i usually don't worry bout titles less they got it right at hand, but get sale/free slip to cover my @$$ in case there hot.

I know what I'm gonna do....I know what I'm gonnnna dooooo!!

That photocopy of the pages from that "Compliance Guide" she sent me with her favorite parts being "Highlighted"......

I'm gonna sue her for giving me "BAD LEGAL ADVICE" !!!!!!!!

Every time you ask a cop down here just what constitutes a violation of a particular law, they get all back offish and say...whoa..I can't give you legal advice....I could get sued!!

Same thing in the circuit court clerks office.....I went in there twice, once to research Habeus Corpus a few years back when one of the Sheriffs deputies got a little rough arresting one of my employees and would'nt let anyone, even his wife see him for a week.....and another time to look up what the burdin of proof was for the crime of receiving stolen property.....they were prosecuting another guy who worked for me...they have a small table for the public to read from a small library of books, the most important of them...the Arkansas State Statute book "Annotated".....
I looked that sucker up, and it stipulated that it was necessary for a conviction that the person buying "stolen property" had to have knowingly purchased it as stolen.....and that the Prosecuting attorney must prove to the jury that the buyer had "Knowingly" purchased stolen property......
A burdin of proof very difficult to prove when this guy had absolutely no criminal record whatsoever....not even a DUI !!
When i asked a clerk about that passage, she reared back...said the same thing the deputy did.....
WHoa there....no way can i give you legal advice.....You could sue me and live off of me!!!

So i think by highlighting the parts of the compliance guide that were "captions" from the Arkansas State Statute Book....she was infact gibing me legal advice that could both be challenged on the state level as well as being unconstitutional......

I don't know.....what do you think Marlin.....have I got a case?????

I don't see how you can live like that. You are welcome to come up here. I pay 5% sales tax and my property tax for my house runs me $600.00 a year. No state income tax or other bs taxes.

Surely the local paper would print this story--almost verbatim the way you have told it. It might not do any good (what would?), but it might raise a big stir, and garner all sorts of local support from folks who have gone through more or less the same BS.

your not their first and won’t be their last ,you are fighting a loosing battle ,they will spend a thousand times more than you owe in taxpayers resources to get that money

I would just send it to them ,you will forget about it after awhile ,it would be better than stowing about it daily and ruining your life over {by thinking about it 24/7}, to me that amount would be worth typing as long as you did about it ,not that I disagree in the slightest ,but it’s just not worth it

The ammount of money has nothing to do with it. Its the principal of the whole thing. And there are 2 reasons it bothers me....The first is this tax out of the blue tactics based on assumptions....and the second, which irritates me even more so than the first reason is that I know this tax for the year 2000 is wrong by "their" rules!! They were informed by 2 methods....a call and a letter in 98....I know they have messed up records because they lost their demads for personal property taxes from the other years.....
I have no respect for a government that "willingly" does not follow the rules that "it itself" has layed out.....

I also think that this is how our country got so bad in the first place.....nobody stood up and said no to a "little scratch" like this $4 demand for money.....and then the little things became bigger and bigger becoming cuts rather than scratches......and they keep cutting little pieces away, and before long we die a death of a thousand cuts.....

And it ain't like i don't pay taxes.....if my memory serves me correctly i believe fed tax this last year was $1500, i think social security tax was somewhere arround $1000, i forget what state tax was....I pay a steep tax every time i fuel up the car, and everybody pays sales tax!!......

No....i ain't gonna pay it.....and i ain't gonna be one of the 95% that turn over their guns when the government comes to my front door on orders from President Hillary Clinton either...
