Stevens 12 gauge double-barreled shotgun

    I'm a legal historian working on an article relating to US v. Miller (1939).
    Unfortunately, I know little or nothing about firearms. I'm wondering
    if anyone can provide me with any information relating to the gun
    Miller and Layton were prosecuted for possessing. It's described only
    as a double-barreled 12 gauge Stevens shotgun with a barrel less than
    18 inches long, presumably sawed-off, ID# 76230. I'd like to know what
    a gun like that would look like, how much it would cost, when it was
    made, how common they were, and what they'd generally be used for. Any
    information anyone can provide would be much appreciated, as would
    suggestions of where else to look. Please feel free to respond to me
    directly, as well. Thanks.

    I think the key to the controversy is found in this statement by the court:
    Because the defense (Miller, et al) did not show up to argue their defense, the court could not "take notice" of testimony not given. Had someone bothered to present even a little bit of testimony, it could have been easily shown that short barreled shotguns were part of the military armament at that time.

    That aside, I personally think the Court erred in tying the right so closely to active militia participation. However, that argument is for another time and place.

    As for cost.....back in 1939 you could probably buy a used double barrel shotgun for about $10 (in 1939 dollars)......that and the price of a hacksaw, and you've got a sawed-off shotgun.

    J. Stevens Arms was bought by Savage Arms in 1920. I believe they continued a line of Stevens shotguns for a while after the acquisition.

    I'm afraid I can't offer much more than that, but there's a forum that specializes in shotguns, the Shotgun World forum, that might be able to provide some information for you.

    You ask "what they'd generally be used for." The answer to that is self-defense and tactical situations. Then and now, people saw off the barrel (and often also the stock) to make the gun smaller and easier to maneuver (and also easier for gangsters to hide under their trench coats).
