Official H.R. 3799 Hearing Protection Act thread

I would like to start a thread dedicated to tracking and discussing only the HPA and questions about it
Mods, I am asking if this could be a sticky please

I would like to see us use this thread to list the more than 70 co sponsors of the bill and if you live in an area where your congressionl rep isn't on board you can get involved.

We have a great chance of getting this voted on soon and signed by President Trump!

Mr. Salmon (for himself, Mr. Guinta, Mr. Carter of Texas, Mr. Kelly of
Pennsylvania, Mr. Collins of New York, Mr. Thompson of Pennsylvania,
Mr. Huelskamp, Mr. Franks of Arizona, Mrs. Love, Mr. LaMalfa, and Mr.
Stewart) introduced the following bill; which was referred to the
Committee on Ways and Means, and in addition to the Committee on the
Judiciary, for a period to be subsequently determined by the Speaker,
in each case for consideration of such provisions as fall within the
jurisdiction of the committee concerned

A BILL

To provide that silencers be treated the same as long guns.

Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ``Hearing Protection Act of 2015''.

SEC. 2. EQUAL TREATMENT OF SILENCERS AND FIREARMS.

(a) In General.--Section 5845(a) of the Internal Revenue Code of
1986 is amended by striking ``(7) any silencer'' and all that follows
through ``; and (8)'' and inserting ``; and (7)''.
(b) Effective Date.--
(1) In general.--The amendment made by this section shall
take effect on the date of the enactment of this Act.
(2) Transfers.--In the case of the tax imposed by section
5811 of such Code, the amendment made by this section shall
apply with respect to transfers after October 22, 2015.

SEC. 3. TREATMENT OF CERTAIN SILENCERS.

Section 5841 of the Internal Revenue Code of 1986 is amended by
adding at the end the following:
``(f) Firearm Silencers.--A person acquiring or possessing a
firearm silencer in accordance with Chapter 44 of title 18, United
States Code, shall be treated as meeting any registration and licensing
requirements of the National Firearms Act (as in effect on the day
before the date of the enactment of this subsection) with respect to
such silencer.''.

SEC. 4. PREEMPTION OF CERTAIN STATE LAWS IN RELATION TO FIREARM
SILENCERS.

Section 927 of title 18, United States Code, is amended by adding
at the end the following: ``Notwithstanding the preceding sentence, a
law of a State or a political subdivision of a State that, as a
condition of lawfully making, transferring, using, possessing, or
transporting a firearm silencer in or affecting interstate or foreign
commerce, imposes a tax on any such conduct, or a marking,
recordkeeping or registration requirement with respect to the firearm
silencer, shall have no force or effect.''.

The text of the bill is a bit confusing.
It abolishes the need and enforcement of the current requirements of getting the tax stamp and all of that but I think you will still have to fill out a 4473 because it says
"to provide that silencers to be treated same as long guns"

Will I be able to make my own legally without paperwork?

Makes no difference. They, the crooks, will get them if they want them, just like right now. Buy it form a crooked dealer, steal them, or just make them. But why would a crook want one? They would be really hard to conceal, and not very fast to draw!

Suppressors make a huge difference even with supersonic ammo...a lot of hunters due to loss of hearing for various reasons use hearing protection when hunting....a Suppressor eliminates that....the supersonic crack happens way out in front of you and it deadens the explosion coming out of end of barrel to a very low level compared to not having Suppressor....IMO they are worth every penny....If this passes I will have several more...I also load and shoot subsonic rounds and the best is 300 Blackout because that is what it was designed for, 220 grain bullet 1000fps out of a barrel as short as 10 inches....designed more as a military application, but also useful in the hunting world....no louder than a pellet rifle...

I think if it passes we will probably seen and large influx of chinese-made suppressors and they will be cheap and there will be plenty of them
Not if Trump imposes a stiff tariff on cheap Chinese imports to protect American producers and jobs.

I haven't heard anything other than they were suppose to have a meeting or something on it the day the congress critters were shot up, wether they did, I don't know. I do know current wait time is 10 months if filed today.:(

Guys, if you want this bill to pass then let your rep and senators know that you want them to pass it. Go to

And sign up for updates for the house and senate versions. Then look up your rep and senators emails and email them stating you want them to support it. This is one of the most watched bills on congress.gov. Don't sit on your hands waiting for it to pass. Do something!

After the Vegas shooting, it doesn't look good for H.R.367 the HPA. Over-the-Hillary already brought up the subject of Suppressors, although she called them Silencers (sounds more ominous) She called for a ban on them, and all the bleeding heart liberal gun haters jumped on board. First Bump-fire stocks and now suppressors.
